CBD And Texas Drug Tests

CrimLaw11

There are many reasons why people use CBD products. For some, CBD helps to reduce daily stress. Others have been advised to use CBD products to alleviate symptoms connected to a medical condition.

Legal in Texas, CBD can still lead to a failed drug test. The part of marijuana that leads to a person experiencing a high is THC, this is not in CBD. But if you believe you received a false positive, you do have options. Talk to a Houston DWI lawyer to have your legal questions answered.

Understanding Differences Types of CBD

The abbreviation CBD is used to reference cannabidiol, one of the chemical compounds that is found in cannabis sativa, commonly called marijuana. But the major chemical compound in marijuana that can result in a person experiencing a high is THC, short for tetrahydrocannabinol, a psychoactive compound. Non-psychoactive CBD does not lead to an individual being high.

That said, it can be possible to fail a drug test, depending on the kind of CBD being used. CBD is available in three types.

  • Pure CBD. Sometimes referred to as CBD isolate, pure CBD is free of the other chemical compounds in cannabis.
  • Full-spectrum CBD. Some of the other compounds of the cannabis can be present in full-spectrum CBD, including very small amounts of THC.
  • Broad-spectrum CBD. CBD that is free of THC but contains all the other chemical compounds of cannabis.

While it is very unlikely that pure CBD use will lead to a failed drug test, it is possible that a full-spectrum CBD will. There are Texas laws in place stating the amount of THC allowed in full-spectrum CBD. The THC level must be under 0.3, but even at a low level it can build up in your system and lead to an amount of THC that will be detected in a drug test.  For example, individuals who are using full-spectrum CBD daily, maybe to alleviate a medical issue, may experience THC build up over time.
